In this Privacy Notice we want to provide you with all necessary information on the handling of your personal data in the course of the use of this website. We prefer to make this information as easily accessible to you as possible. We are using the definitions in the meanings of the GDPR. So, when we speak about personal data in the context of this Privacy Notice this means any information relating to an identified or identifiable natural person (also called a data subject). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier. Such a reference can e.g. be a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

- WHAT DATA DO WE SEE WHEN YOU VISIT THIS WEBSITE
- GENERAL USE OF THIS WEBSITE
1.1 WHAT HAPPENS WHEN VISITING THIS WEBSITE
By visiting this website the following information of the system that you have accessed the website with are processed:
- information on the type of browser
- operational system of the user
- date, time and duration of the access of the website
- numbers of clicks
- information on the location (meaning the country) from where this website was accessed.
This data does not give us the possibility to map individual users, since we cannot see the IP address in this context.

1.3 HOW LONG DOES IT STORE DATA
None of the data mentioned under Section 1 is actually stored in connection with any other personal data and are deleted as soon as your session is over when you leave the website.

The legal basis for the temporary storage of the data described under Section 1 is our legitimate interest (Article 6 para 1 lit. f) GDPR). Our legitimate interest lies in ensuring the display of this website on the device that you are accessing it with.
- SERVICE RELATED DATA
2.1 WHAT HAPPENS WHEN YOU ENGAGE WITH US IN CONNECTION WITH OUR SERVICES
In this case we additionally process
- contractual information (e.g., subject matter of the contract, term, customer category) of our customers, prospective customers and business partners for the purpose of providing contractual services, service and customer care, marketing, advertising and market research.
We only see payment data (e.g., bank details, payment history) in an anonymized version, because we use the provider Fitogram for online bookings on the one hand. For payments on site by card, we use the tool SumUp, where we also see only pseudonymised information. We do not process this information ourselves, SumUp does that. Their privacy notice is available here.
When you transfer money to Lesbionic Shakti’s bank account, we store the data in accordance with applicable laws.
2.2 HOW LONG DOES THIS STORE DATA
The transmitted information will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.
2.3 LEGAL BASIS FOR DOING THIS
The legitimate interest on our side lies in the fulfillment of contractual obligations (Article x para y) and response to the current legal requirements (Article x para y).
2.4 CONTRACTUAL SERVICES
The type of information processed, scope and purpose and the necessity depends on the underlying contractual relationship. In accordance thereto, we process data of our contractual partners and prospective parties as well as other clients, customers, clients or contractual partners (all contractual partners) (Article 6 para 1 lit. b GDPR), in order to provide our contractual or pre-contractual services. This usually comprises the master data (Stammdaten) of our contractual partners (e.g., names, addresses), contact data (e.g., e-mail addresses, phone numbers), contract data (e.g., services used, contract contents) and payment data (e.g., bank details).
In general, we do not process special categories of personal data (besondere Kategorien personenbezogener Daten) (this means data like confession, health), unless this would be required for commissioned or contractual processing.
Any disclosure of information to external parties or companies is made only if it is necessary due to a contract. When processing the data provided to us in connection with our services, we act in accordance with legal requirements as well as potential instructions from clients.
The deletion (Löschung) of data takes place when the respective data is no longer required – this happens with the fulfillment of our contractual or legal duties of care (Fürsorgepflichten) or with any warranty (Gewährleistungspflichten) and comparable obligations.
- GOOGLE & GOOGLE ANALYTICS
3.1 WHAT IS THIS TOOL DOING
This website integrates Google Analytics Site Kit to visualize the data described under Section 1. The service uses “cookies” which are text files that are stored on your used device. The information collected by the cookies is usually sent to a Google server in the USA and stored there. Nevertheless, to our knowledge, Google LLC is complying with the GDPR. The IP address of the user is shortened within the member states of the EU and the European Economic Area and in the other contracting states of the agreement. Only in individual cases is the IP address initially transmitted unabbreviated to a Google server in the USA and shortened there. This shortening eliminates the personal reference of your IP address. The IP address of the user transmitted by the browser is not combined with other data stored by Google.
As part of the agreement on data (alco called a Auftragsdatenvereinbarung) that we, as the website operator, have concluded with Google Inc. when setting up this tool, the latter uses the information collected to evaluate website use and website activity and provides services associated with internet use. The data collected by Google on our behalf is purely intended to evaluate the use of our online offering by individual users, e.g. to create reports on website activity in order to improve our online offering. Also, we are actually not able to identify anyone behind these statistics since the information provided to us does not disclose information that would allow us to trace it back to anyone specific.
3.2 COOKIES & POSSIBILITIES TO OPT-OUT
You have the option of preventing cookies from being stored on your device by making the appropriate settings in your browser. It is not guaranteed that you can access all functions of this website without restrictions if your browser does not allow cookies. Furthermore, you can use a browser plug-in to prevent the information collected by cookies (including your IP address) from being sent to and used by Google Inc. 3.3 HOW LONG DOES THIS TOOL STORE DATA
While using Google Analytics the data received will automatically be deleted after a period of 26 months. This is the standard setting and we have currently not changed this.

The legal basis for having access to the information described under this Section is our legitimate interest (Article 6 para 1 lit. f) GDPR). Our legitimate interest lies in ensuring the display of this website on the device that you are accessing it with. We are also in the process of understanding our readers and students better and this helps us to improve your experience on this website.
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

- COMMENT AND CONTACT FUNCTION ON THIS WEBSITE
4.1 WHAT IS THIS TOOL DOING
If you want to share your thoughts with The Lesbionic you can do this easily by using the commentary function, which you can find under every individual article. The use of the commentary function requires your name and an email-address. All incoming comments are checked beforehand to avoid any and all mis- and abuse. When using this tool, it automatically collects your IP address and browser user agent string to help the detection of potential spam. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here. After the approval of your comment, your profile picture (if any) may be visible to the public in connection with your comment. Some incoming comments may be checked through an automated spam detection service. We do not share your data described under this Section with any third parties and solely use it to potentially engage into a conversation with you.

4.2 HOW LONG DOES THIS TOOL STORE DATA
If you leave a comment under one of The Lesbionic’s articles, the comment and its metadata are retained indefinitely. This helps us to recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. All data provided from you by commenting below individual articles are made available for an undefined term since we want to give other readers the opportunity to read about your thoughts. If at some point you wish to have your comment removed then you can of course contact us to delete it. Apart from that you can pseudonymised your name when entering it into the commentary box. This does work also for your email-address but then you need to bear in mind that in this event The Lesbionic has no further chance of reaching out to you.
4.3 LEGAL BASIS FOR USING THIS TOOL
By wishing to interact with The Lesbionic we understand that you are giving us your consent when providing data. Therefore, our legal basis for the processing and storage of data in the course of the commentary function is your consent for this specific purpose (Art. 6 para 1 lit. A) GDPR). Additionally, The Lesbionic may store the data described under this Section for documentation purposes. The legal basis for this is our legitimate interest (Article 6 para 1 lit. f) GDPR). The Lesbionic’s legitimate interest in storing this kind of data is (i) to understand The Lesbionic’s readers better, (ii) to ensure that this website works smoothly and (iii) most importantly to avoid abusive behaviors on this website.
We do not tolerate any written and / or verbal attacks that do not comply with our principles, i.e., we WILL report any insults, hate comments, offenses and / or other negative experiences, etc. (this list is clearly not exhaustive) that are aimed against the LGBTQIA+ community reaching us in the context of using the comment tool (and obviously also if received via email). To be able to make a report, we will share all data available to us with respective organizations. The Lesbionic’s legal basis for sharing personal data for the purpose of reporting violence against the LGBTQIA+ community is (i) the necessity to protect the vital interests of a natural person (Article 6 para 1 lit. e) GDPR) in the event that the offense is targeting an individual person or several individuals, as well as (ii) our legitimate interest (Article 6 para 1 lit. f) GDPR) in protecting the rights of the LGBTQIA+ community – and therefore also OUR OWN RIGHTS.

6.1 USE OF FITOGRAM
To register for your yoga session with Lesbionic Shakti we are using Fitogram to make your booking easier. For this, you have to get an account with Fitogram. Here (https://drive.google.com/file/d/1wGishX_Z9rZdqdLMin4bNQI2-qY1gIUC/view?usp=sharing) you can find a separate privacy policy of Fitogram (and further information about this provider) which applies in connection when booking your courses on this website via Fitogram (this is only available in German).

6.2 EMBEDDED FRAME
With the use of Fitogram we have integrated an iFrame that shows the calendar and possibilities to book on this website. Therein, Fitogram uses services of third parties. You find all information on what this means for their processing of the data is accessible here. Our legitimate interest in using iFrames is (i) making accessible and (ii) optimizing the website for our users (Article 6 para 1 lit. f GDPR).
- SUMUP
6.1 WHAT DOES THIS TOOL DO
When using the services of Lesbionic Shakti we may offer the option to use our SumUp device. Those devices are owned and operated by SumUp Payments Ltd., Block 8, Harcourt Centre, Charlotte Way, Dublin 2, Ireland D02 K580. In case you decide to use this device to pay for our services, the data that you transmit will be transferred to SumUp.
6.2 LEGAL BASIS FOR USING THIS TOOL
The transfer to SumUp happens because this tool comes from SumUp and they receive this information based on your agreement to it (Article 6 para 1 lit. a GDPR) and to fulfill their contractual relationship (Article 6 para 1 lit. b GDPR).
You can revoke your consent to data processing at any time. A revocation does not affect the validity of past data processing operations.

- NEWSLETTER
If you would like to receive the Lesbionic Shakti newsletter, we require an email address from you as well as information that helps us verifying that you are the owner of the said email address and agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data exclusively for sending the requested newsletter and do not pass it on to third parties.
The processing of the data entered in the newsletter registration form is based exclusively on your consent (Article 6 para. 1 lit. a GDPR). You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, simply reach out to us. The legality of the data processing operations already carried out remains unaffected by the revocation.
The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted after you unsubscribe from the newsletter.

We use the YouTube service of the company Google Ireland Ltd., Gordon House, Barrow Street, 4 Dublin, Ireland, E-Mail: [email protected], site. The processing also takes place in a third country for which there is no Commission adequacy decision. Therefore, the usual level of protection for the GDPR cannot be guaranteed for the transfer, as it cannot be ruled out that in the third country, e.g. authorities can access the collected data.
The legal basis for the transmission of personal data is your consent pursuant to Article 6 para. 1 lit. a GDPR or Article 9 para. 2 lit. a GDPR, which you have given on our website.
Videos from the YouTube platform are integrated on our website via the YouTube service. As part of the order processing, personal data may also be transmitted to the servers of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.
